P'tex veterans file lawsuit

WILMINGTON, DE —
Three former Pillowtex employees have filed a class action lawsuit on behalf of 500 nonunion workers of the bankrupt mill charging they were terminated without cause and in violation of federal worker protection laws.
The action seeks recovery of 60 days' pay and ERISA benefits allegedly because the company failed to provide adequate notice of the firings or adequate severance under the federal WARN Act (Worker Adjustment and Retraining Notification Act).
The suit was filed on the workers' behalf by The NLG Maurice and Jane Sugar Law Center for Economic and Social Justice. Pillowtex has not yet filed a response.
